Too bad about not being able to have the trial of KSM and friends in New York. But don't despair. There is nothing to stop you from transferring a civil court to Guantanamo so they can have a real trial. American history is replete with courts operating under the aegis of an American military compound. This way justice would be served. And while your Republican opponents howl their outrage at your move, you could quietly end your shitty little war in Afghanistan and save enough money to eliminate the need for any cuts. And don't forget to fire the generals who oppose ending your shitty little war. They won't be happy staying in the service anyway.
